Trumps End of Birthright Citizenship: Implications for Indian NRI Families

Chicago, USA: President Trump's decision to end birthright citizenship will impact families in the U.S. with foreign-born children. Previously, children born in the U.S. automatically received citizenship and a passport, regardless of their parents' visa status. However, this will change starting February 19, 2025, following Trump's executive order.

The change primarily affects non-green Card holders, but there is a silver lining for those in the Indian community holding Green Cards.

For families with other visa types, the new policy will prevent their children from obtaining U.S. citizenship. Below are the key scenarios:

Green Card Holders: If both parents hold Green Cards, their child will still receive U.S. citizenship.

H-1B and Green Card Holders: If the mother is on an H-1B visa and the father holds a Green Card, the child will receive U.S. citizenship.

Both Parents on H-1B Visas: If both parents are on H-1B visas, the child will not be granted U.S. citizenship.

H-1B and H-4 Dependent Visa Holders: If the father is on an H-1B visa and the mother holds an H-4 dependent visa, the child will not automatically become a U.S. citizen.

H-1B and Visiting Visa Holders: If the father holds an H-1B visa and the mother is on a visiting visa, the child will not be eligible for U.S. citizenship.

Student Visa Holders: If both parents are on student visas and have a child, the child will not receive U.S. citizenship.

In light of this executive order, it’s clear that Green Card holders within the Indian community do not need to worry, while families with other visa types will face the challenges of this change in policy.
