New regulations that came into effect in early February grant Canadian border officials the power to alter the visa status of students, workers, and immigrants at any time. These measures, aimed at curbing migration, are expected to negatively impact tens of thousands of foreign students, including those from India, as well as applicants for residence permits.
Under the new Immigration and Refugee Protection regulations, Canadian border officers now have the authority to reject temporary residence documents such as Electronic Travel Authorizations (eTAs) and Temporary Resident Visas (TRVs). This means they can cancel work permits and student visas if they believe the person will not leave Canada after their authorized stay. The decision to reject or cancel a permit is entirely at the discretion of the officer.
These changes could impact millions of international students and workers, with Indians forming the largest group in both categories. Canada remains a preferred destination for Indian students, with over 420,000 currently pursuing higher education there. A rejected student or immigrant may be sent back from the port of entry, while those already in Canada may receive a notice to leave by a specified date. The impact on investments, tuition fees, loans, mortgages, and rental agreements remains unclear.
