Missouri Judge Sets Hearing to Assess Innocence Claim of Death Row Inmate Ahead of Scheduled Execution

A Missouri judge has scheduled a hearing for August 21 to determine whether Marcellus Williams, currently on death row for a 1998 murder, is innocent. This critical hearing precedes Williams' scheduled execution by just over a month.

In 2017, Williams was granted a reprieve hours before his execution after new DNA evidence, not available at the time of the crime, indicated that the DNA on the murder weapon did not match Williams'. This revelation prompted St. Louis County Prosecuting Attorney Wesley Bell to file a motion in January to overturn Williams' conviction, leading to the upcoming hearing.

Despite these developments, Williams faces an execution date of September 24 at Bonne Terre, Missouri's state prison. The legal proceedings are unfolding under a 2021 Missouri law allowing prosecutors to challenge convictions if there are doubts about an inmate's guilt.

The outcome of the hearing, which will be decided by St. Louis County Circuit Judge Bruce Hilton, remains uncertain in relation to the impending execution. Should the judge find Williams innocent, it could present a stark dilemma for Missouri, potentially executing an individual subsequently declared innocent by the court.

Missouri Attorney General Andrew Bailey's office opposes efforts to vacate Williams' conviction, raising questions about the execution timeline amidst ongoing legal deliberations. Advocates, including Tricia Rojo Bushnell of the Midwest Innocence Project, advocate for halting the execution pending the court's decision.

This case marks a pivotal moment as Williams becomes the first death row inmate in Missouri to have an innocence claim directly reviewed by a judge, underscoring the unprecedented legal challenges and stakes involved in the pursuit of justice.
